In using this website, reserving products/services, purchasing products/services, and providing information, you are deemed to have read and agreed to the following terms and conditions:
CONDITIONS OF RENTAL
Wherever used herein, the term “equipment” shall include any item or equipment rented from Cross Island Bike Rentals. Equipment is leased to Customer and no transfer of right, title, or interest is given and equipment shall remain the property of Cross Island Cruisers, LLC. The term “Customer” means the person listed in the reservation and all others for whom they obtained equipment. The information provided by Customer is presumed to be the individual who booked the reservation. The person listed in the reservation affirms they have the right to bind and agree to these Terms and Conditions for ALL members of their group.
Cross Island Bike Rentals, its agents, servants, and employees shall not be responsible for personal injuries or property damage, loss or delay incurred by any person arising out of the act of negligence of any direct or supplemental carrier or other person rendering any of the services or products being offered in these rentals; nor shall Cross Island Bike Rentals be responsible for any injuries, death, damage, loss or delay in any means of transportation or by reasons of any event beyond the actual control of Cross Island Bike Rentals, or of any agent or supplier, or due to force majeure.
The bicycles provided for use are in satisfactory operating condition and participants agree to use them at their own risk or call deficiencies to the attention of a company representative. Individual bike specifications are subject to change based on availability of replacement components. Instruction in the use of bicycles will not be provided and participants affirm that they are competent and familiar with the use of a bicycle.
Renters follow any suggested itinerary at their own risk and agree not to hold Cross Island Bike Rentals or Cross Island Cruisers, LLC. responsible for injury or death resulting from accidents. We strongly recommend the use of approved helmets whenever mounted on a bicycle. Helmets can be provided at additional cost for beach cruiser rentals.
HELMETS
Cross Island Cruisers, LLC recommends Customer use a helmet when riding a bicycle of any type and will provide helmets at an additional cost. Customers who do not use a helmet do so at their own will and at their own peril.
WAIVER OF LIABILITY
Customer understands and accepts that using the equipment exposes Customer to potential hazards. In recognition of the inherent risks associated with the rental and use of equipment, Customer confirms for themselves and all parties within the reservation that they are physically and mentally capable of participating in the activity and using the equipment. Customer further acknowledge they are participating willingly and voluntarily. Customer knowingly and freely assume all such risks, both known and unknown, including, but not limited to personal bodily injury, mental injury, accidents, illnesses, and death, even if arising from the negligence of those persons released from liability herein and assume full responsibility for participation. Customer also assume all responsibility for damage to or loss of personal property as the result of any accident or incident that may occur. In consideration of services or equipment provided, Customer, on behalf of their heirs, successors, assigns, next of kin, and personal representatives, do hereby release and forever discharge and hold harmless Cross Island Cruisers, LLC, its DBAs, principals, directors, trustees, officers, owners, agents, and employees from all liability arising out of the activity and waive any claim for damage arising from any cause whatsoever, including but not limited to all personal, bodily or mental injury, disability, death and loss or damage to person or property, whether caused by the negligence of the those persons released or otherwise. Customer also agrees to indemnify and hold harmless Cross Island Cruisers, LLC, its DBAs, principals, directors, trustees, officers, owners, agents, and employees from all claims, judgments and costs, including attorney’s fees, incurred in connection with any action brought as a result of Customer's use of equipment.
CONSENT TO CONTACT
Customer agrees that Cross Island Cruisers LLC, its DBAs, and employees may contact Customer utilizing information provided by Customer. Customer confirms that the information provided is correct and is responsible for updating information as it changes. Customer has the right to opt out of any marketing contact by notifying Cross Island Cruisers, LLC in writing of its request. Cross Island Cruisers, LLC may contact Customer for reasons related to its rental of equipment irregardless of marketing preference.
CUSTOMER INSPECTION
Customer agrees and acknowledges they are to inspect equipment upon receipt and should they find any equipment not in proper mechanical or aesthetic condition, they shall immediately notify Cross Island Cruisers LLC through one of its DBAs within 24 hours of receipt of rental equipment otherwise Customer may become liable under the terms of this agreement. Upon use of equipment, Customer accepts the condition of equipment as is, agrees it is in proper functioning condition, and accepts responsibility for the care of equipment while in Customer's possession. Customer further understands equipment may not have visibility enhancement equipment, such as reflectors, blinking lights, or other lights, and agrees to use of equipment in its delivered condition.
MAINTENANCE, TUNING AND RESPONSIBILITY
Although all our rental bikes are professionally serviced before dispatch, bicycles may need tuning or maintenance during the course of the rental period; such maintenance will be carried out by Cross Island Bike Rentals. We are happy to exchange or fix rental bikes for any issue that may arise during the course of your rental as per our Customer Service Policy.
USE OF EQUIPMENT
Customer agrees to use equipment in a safe manner and in accordance with all South Carolina traffic laws and regulations as well as the regulations and ordinances of the Town of Hilton Head and neighborhood requirements governing use of equipment. Customer shall not misuse or abuse equipment and agrees to not subject equipment to any unsafe use, use while under the effect of alcohol or drugs, and not assign its rights to use of equipment. Customer shall not use phones or cameras while riding. Customer shall not subject equipment to any body of water, including the ocean and tidal pools, and is responsible for all water damage. Customer shall only ride on open paths, trails and roads and shall not trespass. Customer agrees not to modify, change, add, or remove items from equipment. Customer understands how to use the equipment and acknowledge Customer is responsible for the safe use of equipment for all members of its group and shall ensure their safe use of equipment. Customer agrees no child will be left unattended in any child seat, carrier, or any other equipment. Customer shall return equipment to the same or agreed upon location as it was delivered to them at the end of their rental period clean and undamaged. Bike attachments may not be attached to bikes/equipment that does not belong to Cross Island Cruisers, LLC.
PAYMENTS, CANCELLATION, & REFUNDS
All payments shall be made in full at the time of order. Orders may be canceled up until 10:00AM the day before a rental begins and receive a full refund. After that time, all orders are final and no rain checks or refunds will be given. Once equipment is delivered, should Customer not be able to utilize equipment for the full rental period for any reason, no refund for unused time will be given. If the rental period is extended, the Customer authorizes the Company to charge the credit card on file for monies due without the cardholder present. If any action is brought to enforce any of the terms of conditions of this agreement, or to recover any sums due to hereunder, Customer agrees to pay all legal fees, court costs, or other expenses. Rentals ending before the end date are not eligible for refund. Any applicable refunds will be issued upon return of all rented equipment.
CHOICE OF LAW AND VENUE
The rental and this agreement shall be governed and interpreted solely in accordance with the law of the State of South Carolina. Any litigation involving the use of equipment shall be brought solely within the State of South Carolina and shall be in the exclusive jurisdiction of the courts of Beaufort County South Carolina. If any provision is deemed invalid or unenforceable, the remainder of this agreement remains in full force and effect.
RESPONSIBILITY FOR DAMAGE, LOSS AND/OR LATE RETURN.
RESPONSIBILITY FOR DAMAGE OR LOSS
Customer agrees he/she will return the equipment in the same good condition as when received, ordinary wear and tear accepted, and to bear the cost of repair or replacement of lost or stolen, damaged or broken bicycles or parts to Cross Island Bike Rentals for said equipment. Customer assumes liability for any and all damage or loss of equipment and damage or loss to personal property, accident/injury to other persons related to the use of equipment. It is Customer's responsibility to prevent damage, loss, or theft of equipment. Therefore regardless of the party at fault, Customer understands and agrees to be responsible for the theft or damage to said equipment. Customer shall assume liability for any and all damage or loss of and to personal property, accident / injury to other persons related to said rental equipment.
It is Customer's responsibility to prevent damage, loss, or theft of equipment. In case of theft a formal Police Report must be lodged and a copy must be forwarded to us. Customer is responsible for the cost of excessive cleaning and to repair any damage to equipment while in Customer's possession at the normal shop rate plus retail cost of repair parts required to return equipment to its condition at time of rental. Should equipment be lost or stolen, Customer agrees to pay the current replacement cost. There are no warranties, expressed or implied, in connection with the use of the rented equipment. Customer agrees Cross Island Cruisers, LLC may charge the credit card on file for any damage or late return fees.
LATE RETURN FEE :
An additional fee in the form of the current daily rental rate will be charged for each day Customer keeps equipment after the return date specified on the reservation without an extension to their rental. All equipment must be returned directly to Cross Island Bike Rentals or wherever agreed.
DELIVERY, RIDE OFF, & PICKUP
Delivery and collection service is subject to approval by management based on delivery or pick-up location. Delivery and pick-up of equipment is included within the traditional tourist destination areas of Hilton Head Island. Delivery fee to areas outside of the traditional tourist areas is a minimum $20 additional charge. Should there be a gate fee associated with entrance to a private neighborhood for which Cross Island Cruisers, LLC does not have a commercial pass, Customer shall provide a pass or pay the cost associated with obtaining such passes. Customer must provide delivery address at time of order. Renters are responsible for ensuring that management at their accommodation is agreeable to accepting bike delivery and providing safe storage for bikes at their location. Similarly, renters are responsible for ensuring that management at the designated collection address are agreeable to safely storing bikes on the property. Renters staying in private residences must place rented bikes in a location that our delivery driver has access to for pickup. Bikes stored in closed garages or behind locked fences on the day of pickup will be charged the LATE RETURN FEE at the current daily rate for each additional day that the bikes are inaccessible for collection.
The “Start Time” on the order page is only for store reference, it is not the exact time of rental start. One day and two day rentals are for 24 - 48 hour periods starting from the time of ride off or upon delivery. Three or more day rentals are from the day delivered as the first day to approximately the number of rental days later. For example a Saturday 7-day rental begins at time of delivery Saturday and ends on Friday at the selected collection window time. Customer may choose to have a morning or evening pickup on the day of collection. We ask that rental equipment be available at the beginning of their chosen collection window. Bikes and equipment must be made available by 8:00am for morning collections and 3:00pm for evening collections. Cross Island Bike Rentals recommends Weekly rates at no additional cost for weekly rentals to be picked up the morning of the following week's day. In times of high demand, deliveries will be made based on a combination of the date the order was placed, length of rental, and proprietary logistics optimization processes. During times of high demand, Cross Island Cruisers, LLC reserves the right to deliver orders for Saturday delivery after hours or the following Sunday morning without any discount owed to or right to cancel by Customer.
TERMINATION OF AGREEMENT:
Customer agrees Cross Island Cruisers, LLC has the right to terminate this agreement and the rental contract at any time and re-take possession of said equipment and for said purpose Cross Island Cruisers, LLC, its DBAs, and employees may enter the property or premises where equipment is located to effect its return without liability for trespassing.
ACCEPTANCE OF TERMS AND CONDITIONS
Customer understands and agrees to its acceptance of Cross Island Cruisers, LLC's Terms and Conditions by either checking the acceptance box during online ordering; having the Terms and Conditions link emailed to Customer with their confirmation email; and/or through their use of equipment constitutes the equivalent of a legal signature confirming their agreement to all Terms and Conditions set forth in this agreement. Should Customer not agree with these Terms and Conditions, Customer shall not utilize any equipment and immediately contact Cross Island Cruisers, LLC at the number listed in its rental communications.
As per the Terms and Conditions of this Rental Agreement, Customer agrees with the following statements:
1. Cross Island Cruisers LLC, DBA Cross Island Bike Rental, agrees to rent the described equipment to the Customer.
2. All rent due hereunder for the rental of the equipment by me shall be paid in advance at the time of reservation.
3. I will inspect the equipment to be rented by me upon delivery as described and I accept full responsibility for the care of the equipment while it is in my possession. Any damage to the equipment other than caused by reasonable wear and tear, shall be my responsibility and shall be repaired or replaced by Cross Island Cruisers LLC at my sole cost and expense.
4. I will be responsible for the replacement at full retail value of any equipment rented under this agreement, but not returned to Cross Island Cruisers LLC. Bike(s) will be returned to Cross Island Bike Rentals at 13 Executive Park Road or the established residential address agreed upon at time of confirmation.
5. I agree to return to Cross Island Cruisers LLC all equipment rented under this agreement by the agreed date and time in a clean condition to avoid any additional charges for which I will be responsible.
6. I agree to hold harmless and indemnify Cross Island Cruisers LLC and its owners, agents, affiliates, servants, and employees for any loss or damage, including any that results from, claims, demands, actions, and/or property damage related to the use of the equipment rented under this agreement.
7. I understand that there are inherent and other risks involved in the sport for which this equipment is to be used, that injuries are a common and ordinary occurrence of the sport, and I freely assume those risks including the risk of injury to myself and to third persons and of damage to my property and property of others.
8. I agree that only the person to whom the equipment is rented and those in their party shall use the equipment.
9. I hereby release, remise and discharge Cross Island Cruisers LLC and its owners, agents, affiliates, servants, and employees from any and all liability for damage and injury to myself and/or to any other person and/or property resulting from negligence, installation, maintenance, selection, adjustment, and/or use of the equipment rented hereunder, or any other fault, accepting myself that full responsibility for any and all such damage and/or injury which may result there from.
10. For any contract or other action against Cross Island Cruisers LLC the damages are limited to the amount of rental fee only. I agree that no consequential damages can be collected.
11. The parties agree and understand that if any clause or phrase of this agreement is unenforceable or invalidated by law the rest of this agreement is to remain in full force and effect.
12. As a renter, I certify that I am 18 years of age or older.
13. All instructions on the use of my rental equipment have been made clear to me, and I understand the use and function of the equipment. I, the Customer, intending to be legally bound and in consideration of the equipment provided for my use, have read and understand the rental and release agreement above and agree to be bound by all of the above terms and conditions including the limitation of liability of Cross Island Cruisers LLC
CUSTOMER SERVICE POLICY:
Our Customer Service line is open 24/7 to handle any issues or problems you have during your rental. We are happy to attend to any service or maintenance issues as promptly as possible, usually within 2 hours. Service calls to customers inside gated communities are restricted to commercial hours and cannot be serviced after 7PM. We will do our best to attend to customers who have issues or break downs while out riding as soon as reasonably possible. If you have ordered the wrong size and would like to swap out your rental, please notify us as soon as possible and we will have it traded out within 24 hours. Size/equipment swaps are subject to current product availability.

ACCEPTANCE OF TERMS AND CONDITIONS
Customer understands and agrees to its acceptance of Cross Island Cruisers, LLC's Terms and Conditions by either checking the acceptance box during online ordering; having the Terms and Conditions link emailed to Customer with their confirmation email; and/or through their use of equipment constitutes the equivalent of a legal signature confirming their agreement to all Terms and Conditions set forth in this agreement. Should Customer not agree with these Terms and Conditions, Customer shall not utilize any equipment and immediately contact Cross Island Cruisers, LLC at the number listed in its rental communications.
As per the Terms and Conditions of this Rental Agreement, Customer agrees with the following statements:
1. Cross Island Cruisers LLC, DBA Cross Island Bike Rental, agrees to rent the described equipment to the Customer.
2. All rent due hereunder for the rental of the equipment by me shall be paid in advance at the time of reservation.
3. I will inspect the equipment to be rented by me upon delivery as described and I accept full responsibility for the care of the equipment while it is in my possession. Any damage to the equipment other than caused by reasonable wear and tear, shall be my responsibility and shall be repaired or replaced by Cross Island Cruisers LLC at my sole cost and expense.
4. I will be responsible for the replacement at full retail value of any equipment rented under this agreement, but not returned to Cross Island Cruisers LLC. Bike(s) will be returned to Cross Island Bike Rentals at 13 Executive Park Road or the established residential address agreed upon at time of confirmation.
5. I agree to return to Cross Island Cruisers LLC all equipment rented under this agreement by the agreed date and time in a clean condition to avoid any additional charges for which I will be responsible.
6. I agree to hold harmless and indemnify Cross Island Cruisers LLC and its owners, agents, affiliates, servants, and employees for any loss or damage, including any that results from, claims, demands, actions, and/or property damage related to the use of the equipment rented under this agreement.
7. I understand that there are inherent and other risks involved in the sport for which this equipment is to be used, that injuries are a common and ordinary occurrence of the sport, and I freely assume those risks including the risk of injury to myself and to third persons and of damage to my property and property of others.
8. I agree that only the person to whom the equipment is rented and those in their party shall use the equipment.
9. I hereby release, remise and discharge Cross Island Cruisers LLC and its owners, agents, affiliates, servants, and employees from any and all liability for damage and injury to myself and/or to any other person and/or property resulting from negligence, installation, maintenance, selection, adjustment, and/or use of the equipment rented hereunder, or any other fault, accepting myself that full responsibility for any and all such damage and/or injury which may result there from.
10. For any contract or other action against Cross Island Cruisers LLC the damages are limited to the amount of rental fee only. I agree that no consequential damages can be collected.
11. The parties agree and understand that if any clause or phrase of this agreement is unenforceable or invalidated by law the rest of this agreement is to remain in full force and effect.
12. As a renter, I certify that I am 18 years of age or older.
13. All instructions on the use of my rental equipment have been made clear to me, and I understand the use and function of the equipment. I, the Customer, intending to be legally bound and in consideration of the equipment provided for my use, have read and understand the rental and release agreement above and agree to be bound by all of the above terms and conditions including the limitation of liability of Cross Island Cruisers LLC
CUSTOMER SERVICE POLICY:
Our Customer Service line is open 24/7 to handle any issues or problems you have during your rental. We are happy to attend to any service or maintenance issues as promptly as possible, usually within 2 hours. Service calls to customers inside gated communities are restricted to commercial hours and cannot be serviced after 7PM. We will do our best to attend to customers who have issues or break downs while out riding as soon as reasonably possible. If you have ordered the wrong size and would like to swap out your rental, please notify us as soon as possible and we will have it traded out within 24 hours. Size/equipment swaps are subject to current product availability.
